The incident occurred at a high school football game between P.D. Jackson-Olin High School and Minor High School in Birmingham, Alabama.
After the game, police officers asked both school's band directors to stop playing music to clear the stadium.
Johnny Mims, the band director for Minor High School, allegedly did not comply with multiple requests from officers to stop the performance..
A physical altercation ensued between Mims, Birmingham City Schools System Security personnel, and Birmingham Police Department (BPD) officers.
During the altercation, BPD officers attempted to arrest Mims by instructing him to place his hands behind his back
Mims allegedly refused to comply with the arrest, and an officer used a Taser to subdue him, ending the physical confrontation.
Johnny Mims was subsequently charged with disorderly conduct, harassment, and resisting arrest.
Following the incident, Mims was treated by Birmingham Fire and Rescue and transported to UAB Hospital as part of standard protocol
The incident is under investigation by the Birmingham Police Department’s Internal Affairs Division
Mims' attorney, Juandalynn Givan, plans to pursue legal action against the department, alleging an abuse of power and a violation of civil rights. Johnny Mims is currently on administrative leave with pay pending the investigation.
